Common scenarios that require a fence permit

Some councils impose specific regulations for fence construction that differ from general Building Regulations. These are the situations where a building permit is typically required in Victoria.

Side & rear boundary fences

Fences taller than 2 metres on side or rear boundaries generally require a permit.

Front fences

Brick or masonry over 1.2 m, and timber or metal over 1.5 m, require a building permit.

Near street intersections

Fences over 1 m located within a set distance of a street intersection need approval.

Pool & spa fencing

All pool and spa safety barrier installations and alterations require a building permit.

Shared boundary fences

Shared fences must comply with the Fences Act 1968, including your neighbour's consent.

Risks of no permit

Penalties, removal orders to dismantle non-compliant fences, and added costs and delays.

QUESTIONS ANSWERED

Fence Building Permit FAQs

  • When do I need a permit for a fence?

A permit is required for most fences, particularly if they exceed 2 metres in height, are located near a street, or are constructed from specific materials. There are exemptions, such as side and rear timber fences under 2 m or front fences under 1.2 m. It is always best to check with Code HQ or your local council for specific requirements.

  • Do I need my neighbour's consent to build a fence?

All shared boundary fences must comply with the Fences Act 1968, which involves obtaining the adjoining owner's consent for any works to a shared boundary fence. There is plenty of public information available online about this legal process.

  • What are the height rules for front fences?

Brick or masonry front fences greater than 1.2 metres, and timber or metal front fences greater than 1.5 metres, generally require a building permit. Fences over 1 metre near a street intersection may also need approval.

  • Do pool and spa fences need a permit?

Yes. All pool and spa safety barrier installations and alterations require a building permit. We can handle your barrier permit alongside the rest of your project.

  • What happens if I build a fence without a permit?

Building without the proper permit can lead to penalties, removal orders requiring you to dismantle a non-compliant fence, and additional costs and delays to fix or remove the work.

WHY PEOPLE CHOOSE CODE HQ

Trusted by Victorian builders and owners

The building industry can be a tricky space to work in with everyone working to tight timelines and wanting to get jobs done. However, no matter what time frame you are working to, it still has to be done right and to regulation. As a qualified Carpenter for many years I am appalled at those that have complained that they had to change something for it was not to regulation after being inspected. You should be ashamed of yourself as a tradesman of the Building Industry. For the building industry has suffered, with too many unskilled tradesmen that just want to cut corners and customers ending up with bad workmanship. So, when an inspector states that it is not to regulation then it is not right and needs to be changed. This is what inspectors are there for, to keep the industry in line with regulations so construction is done at a high standard, right the first time and safe.
